These Terms and Conditions (“Terms”) govern your access to and use of www.northwave.com.au (the “Site”) and any purchase of products made through the Site.

We may suspend or terminate access to the Site at any time if you breach these Terms.

3. PRODUCT INFORMATION

We take reasonable care to ensure product descriptions, images and pricing are accurate. However:

  • Images are for illustrative purposes only
  • Colours and finishes may vary slightly
  • Specifications may change without notice

If we discover an error, we reserve the right to correct it and cancel or amend affected orders.

4. PRICING & PAYMENT

  • All prices are listed in Australian Dollars (AUD)
  • Prices include GST where applicable
  • Prices may change at any time prior to an order being accepted
  • Payment must be received in full before dispatch

Accepted payment methods are displayed at checkout and may change from time to time.

If a pricing or system error occurs, we may cancel the order and issue a full refund.

5. ORDERS & CONTRACT FORMATION

By placing an order, you are making an offer to purchase the products in that order.

A binding contract is formed when we issue an order confirmation email.

Each order constitutes a separate contract.

We reserve the right to:

  • Refuse or cancel any order
  • Limit quantities purchased per customer, address or order
  • Cancel orders where payment verification fails or fraud is suspected

6. AVAILABILITY & CANCELLATIONS

Products are subject to availability.

If a product becomes unavailable after you place an order:

  • We will notify you as soon as practicable
  • A refund will be issued for the unavailable item(s)

If we are unable to contact you using the details provided, we may cancel the order and refund any amounts paid.

7. SHIPPING & DELIVERY

Shipping, delivery timeframes and costs are governed by our Shipping, Returns & Warranty Policy, which forms part of these Terms.

  • Orders are fulfilled from BikeChain HQ, Australia
  • Delivery timeframes are estimates only
  • Orders may be shipped in multiple consignments at no additional cost
  • We are not responsible for delivery delays caused by factors outside our control

8. RETURNS & REFUNDS

Returns, refunds and exchanges are governed by our Shipping, Returns & Warranty Policy.

That policy forms part of these Terms and must be read together with them.

9. WARRANTIES & AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to:

  • A replacement or refund for a major failure, and
  • Compensation for any other reasonably foreseeable loss or damage

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Any manufacturer’s warranty applies in addition to your ACL rights.

10. PROMOTIONS & DISCOUNTS

From time to time, we may offer promotional codes or discounts.

Unless stated otherwise:

  • Codes must be applied at checkout
  • Only one promotion may be used per order
  • Promotions cannot be applied retrospectively

Additional terms may apply to specific promotions.

11. GIFT CARDS (IF APPLICABLE)

Where gift cards are offered:

  • Gift cards are not redeemable for cash
  • Gift cards cannot be refunded
  • Validity periods will be stated at purchase

12. FRAUD PREVENTION

We reserve the right to:

  • Verify identity or payment details
  • Place orders on hold pending verification
  • Cancel orders where fraud is suspected

Failure to provide requested verification may result in order cancellation and refund.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • We exclude liability for indirect, incidental or consequential loss
  • Our liability for breach of any consumer guarantee is limited to the remedies required under the ACL
  • Nothing in these Terms excludes liability that cannot be excluded by law

We are not responsible for the content, security or practices of third-party websites. Accessing third-party sites is at your own risk.

15. INTELLECTUAL PROPERTY

All content on this Site (including text, images, logos and trademarks) is owned by or licensed to Northwave Australia.

You must not reproduce, distribute or use Site content without prior written consent.

16. TERMINATION

We may terminate or suspend your access to the Site:

  • For breach of these Terms
  • For suspected fraud or misuse
  • Where required by law

Termination does not affect accrued rights or obligations.

18. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia.

You submit to the exclusive jurisdiction of the courts of Victoria.
